To request the appointment of a Guardian, it is necessary to submit a written application (called a 'petition') to the guardianship judge at the court where the interested person (the beneficiary) resides or is domiciled.

 

The procedure is characterized by short timelines: from the date of filing the petition with the registry, the guardianship judge appoints the guardian within 60 days, after personally hearing the beneficiary, assessing their needs and health status.

 

In cases of urgency, the guardianship judge may appoint a temporary guardian a few weeks after the petition is filed in situations where immediate intervention is required to protect the vulnerable person (e.g., signing an informed consent for a medical procedure, making an urgent payment, risk of exploitation by third parties)
